Část 15. Nezapsané ochranné známky (str. 17)
Pokud Žadatel uplatňuje Přednostní právo ke jménu na základě
(i) všeobecně známé nezapsané ochranné známky, jak stanoví článek 6bis Pařížské úmluvy na ochranu průmyslového vlastnictví (v aktuálním znění), nebo
(ii) nezapsané ochranné známky, která nespadá pod odstavec (i) výše a která je chráněna dle zákonů jednoho z členských států, jenž je uveden v Příloze 1 jako členský stát, který chrání nezapsané ochranné známky,
stačí prokázat existenci takového Přednostního práva v souladu s částí 12 odst. 2 nebo částí 12 odst. 3 těchto pravidel, aniž by bylo povinné poskytnout Písemné důkazy uvedené v části 12 odst. 1.
Note on the Paris Convention:
The purpose of this agreement is to protect industrial rights, such as patents for inventions, utility models, industrial designs or models, factory or trade mark, service mark, trade name and particulars of the origin of the goods or of the designation of origin, and protection against unfair competition.
In the Czech Republic is this Convention enshrined in law 64/1975.
